1. Controller identity and address

Cadmiel Jearim Rivera Perdomo, an individual doing business as VideoKrtoon (“VideoKrtoon”), is responsible for the personal-data processing described in this Notice.

This Notice applies to videokrtoon.com, VideoScribe Tracer, Real Estate Studio, forms, accounts, payments, support, and related creative services.

2. Personal data we may process

Depending on your interaction, we may process:

  • Identity and contact data: name, email, telephone, country, company, and information in forms or communications.
  • Account and authentication data: username, internal identifiers, cryptographically protected password, account status, preferences, and access logs.
  • Project and content data: images, drawings, logos, property photographs, floor plans, references, text, prompts, output files, and related metadata.
  • Purchase and billing data: plan, amount, currency, date, billing address, customer and transaction identifiers, payment status, refunds, and limited payment-method data received from Stripe or PayPal, such as brand and last digits, account identifier, or associated email, depending on the processor.
  • Usage and technical data: IP address, device, browser, operating system, time zone, pages and features used, creations, exports, errors, sessions, first Paid Use, and security logs.
  • Support and communication data: messages, requests, attachments, recordings when disclosed in advance, service history, and contact preferences.
  • Cookie, analytics, and advertising data: cookie identifiers, consent choices, referral source, campaign interaction, and browsing information in line with your selections.
  • Third-party data: Stripe or PayPal confirmations, authorized integration data, connected social-platform data, and information from providers involved in delivery.

We do not intentionally request sensitive personal data. Do not include health, biometric, genetic, belief, sexual-orientation, political-opinion, or other sensitive information in files or prompts. If exceptionally necessary, we will request required consent and apply additional safeguards.

Your uploads may contain another person’s data. You must have a lawful basis, permission, or sufficient right to provide it and must give that person this Notice where appropriate.

3. Necessary primary purposes

We use data to:

  • Create, authenticate, maintain, and secure accounts.
  • Provide VideoScribe Tracer, Real Estate Studio, and purchased creative services.
  • Process images, files, prompts, exports, and workflows requested by you.
  • Process payments, subscriptions, renewals, cancellations, refunds, taxes, and billing through Stripe or, for VideoScribe Tracer, PayPal.
  • Verify Paid Use and apply subscription and refund terms.
  • Send transactional messages about accounts, security, payments, renewals, service, and support.
  • Handle support, rights requests, and complaints.
  • Detect abuse, fraud, unauthorized access, and vulnerabilities; investigate incidents; and enforce the Terms.
  • Maintain, debug, measure, and improve Service operation, security, and accessibility.
  • Meet legal, tax, accounting, administrative, and valid government requirements.
  • Establish, exercise, or defend legal rights.

These purposes are necessary for the legal relationship, requested service, or compliance obligations. Without certain data, we may be unable to create an account, process payment, or provide the Service.

4. Optional secondary purposes

Only with applicable consent may we use contact, preference, usage, or interaction data to:

  • Send promotions, news, tips, and offers by email, SMS, or WhatsApp.
  • Create advertising audiences or measure campaigns on third-party platforms.
  • Personalize non-essential advertising.
  • Publish testimonials, names, companies, or content in portfolios.
  • Conduct surveys or non-essential commercial research.

Refusing or withdrawing consent does not affect your account or paid Services. Withdraw through an unsubscribe link, consent settings, or contact@videokrtoon.com.

Necessary payment, security, renewal, and support messages are not advertising and may continue while a relationship or obligation exists.

5. Consent

Where processing depends on consent, it must be free, specific, and informed. We will request express consent for financial or property data and when otherwise required by law. You may withdraw consent without retroactive effect.

Accepting Terms or purchasing does not itself consent to marketing. Promotional boxes must be separate, optional, and unchecked by default.

6. Stripe, PayPal, and payment data

Stripe processes payments for VideoKrtoon, and PayPal may also process VideoScribe Tracer payments. Each processor may process certain data for its own legal, regulatory, security, and fraud-prevention purposes. Stripe or PayPal may receive contact, billing, device, payment-method, and transaction data under their respective privacy policies.

VideoKrtoon receives confirmations and metadata needed to administer purchases. When the integrations operate as intended, VideoKrtoon does not receive or store a full card number, security code, PayPal password, or complete details of the funding source linked to the PayPal account.

7. OpenAI and Google models

VideoKrtoon currently uses Google Nano Banana 2, Google Nano Banana Pro, and Google Veo 3.1 Fast, as well as OpenAI GPT Image 2. Depending on the stage and selected model, we may send the provider images, drawings, property photographs, floor plans, text, private instructions, technical parameters, and request identifiers. We receive generated results, status information, errors, usage, and metadata needed to deliver the feature, record costs, and provide support.

Nano Banana 2 is currently used for Land, House, and Interiors; Nano Banana 2, Nano Banana Pro, and GPT Image 2 are available in Free edit; and Veo 3.1 Fast is used in Animation.

The Studio may state that a final instruction is private, not displayed, and not stored in the library. Even so, that instruction and necessary files are transmitted to the selected provider to perform the request. The statement concerns the VideoKrtoon interface and library; it does not mean that content never leaves the Studio systems.

According to OpenAI’s official documentation, data sent through the API is not used to train or improve its models unless the account holder expressly opts in to share it. By default, certain abuse-monitoring logs may retain content and metadata for up to 30 days, while some endpoints may retain application state for other periods. VideoKrtoon’s specific configuration depends on the endpoints and data controls it enables.

Google models can be accessed through the Gemini API/Google AI Studio or Vertex AI, whose data terms may differ. When Veo is used through the Gemini API, Google states that generated videos are stored on its servers for two days, undergo safety filtering, and receive a SynthID watermark. VideoKrtoon must identify and document the active API channel.

Seedream and Kling will not be described as active providers until their integrations are enabled. If added, we will update this Notice or the provider list before sending them data and explain the relevant categories, purposes, and conditions.

Users should not provide VideoKrtoon with passwords for OpenAI, Google, Seedream, or Kling. Requests are made using API credentials managed by VideoKrtoon.

VideoKrtoon will not use private User Content in portfolios, public advertising, or its own model training without additional, specific consent.

8. Processors, third parties, and transfers

We may provide limited data to providers assisting with:

  • Payments and fraud prevention, including Stripe and PayPal for VideoScribe Tracer.
  • Hosting, databases, security, backups, and content delivery.
  • Email, support, and communications.
  • Analytics and consent management, including Google Analytics when authorized.
  • Artificial intelligence, currently through Google Nano Banana 2, Nano Banana Pro, and Veo 3.1 Fast, and OpenAI GPT Image 2; Seedream and Kling only when enabled and disclosed.
  • Professional advice, audit, accounting, and legal defense under confidentiality duties.

We may also disclose data in response to a valid government request, to protect rights or safety, or during a business reorganization or transfer subject to equivalent privacy duties.

Providers acting only on VideoKrtoon instructions must be contractually bound to confidentiality, security, and purpose limitations. Where a disclosure is a transfer to a third party rather than a processor and no legal exception applies, we will request required consent and provide the applicable Notice and purposes.

We do not sell personal data for money. Personalized advertising or audience creation will occur only in line with your choices and applicable law.

9. International processing

Some providers may process data outside Mexico. We will use reasonable contractual, technical, and organizational safeguards and communicate applicable purposes and obligations. Where consent is legally required for a transfer, we will request it in advance.

10. Cookies and similar technologies

We use strictly necessary cookies for security, session, preferences, and operation. With your selection, we may enable analytics, performance, or marketing cookies.

The “Manage consent” panel lets you accept, reject, or change non-essential categories. Rejecting non-essential cookies should not prevent core functions, although optional features may be limited.

The current cookie list, providers, durations, and purposes should be available through consent settings. Marketing technologies must not activate before consent where legally required.

11. Retention

We retain data only as long as needed for disclosed purposes and then block or delete it under law and our processes:

  • Account data is retained while active and for the period needed for claims, security, and legal duties.
  • Payment, billing, and transaction records are retained for applicable tax, accounting, and limitation periods.
  • Content and files are retained for processing, contracted availability, support, and reasonable backup cycles unless another period is disclosed.
  • Technical and Paid Use logs are retained for a proportionate period for security, fraud prevention, support, and disputes.
  • Marketing data is used until consent is withdrawn or an objection is made; afterward, only minimal evidence is retained to honor the choice.

When no longer needed, data will be deleted after blocking where appropriate. Data about breach of contractual obligations will be deleted according to Mexican statutory periods.

12. Security and confidentiality

We maintain reasonable administrative, technical, and physical safeguards based on risk, including access restrictions, credential protection, encryption in transit where appropriate, backups, logging, and provider management.

No system is fully secure. If a breach significantly affects your property or moral rights, we will inform you immediately so you can take protective measures.

People involved in processing remain subject to confidentiality after their relationship with VideoKrtoon ends.

13. ARCO rights and other choices

You may exercise rights to:

  • Access data and processing conditions.
  • Rectify inaccurate, incomplete, or outdated data.
  • Cancel data through blocking and deletion where applicable.
  • Object to processing for a legitimate reason or applicable purpose.

You may also withdraw consent or limit use and disclosure.

Send requests to contact@videokrtoon.com with:

  1. Your name and a contact method.
  2. Identity or representation documents only when necessary.
  3. A clear description of the data and right requested.
  4. Information helping us locate the data and, for rectification, supporting documentation.

We will communicate a decision within twenty business days after receiving a complete request. If granted, we will implement it within the next fifteen business days. A deadline may be extended once when justified.

Rights are free to exercise except legally permitted reproduction or delivery costs. We may retain data where required by law, necessary for contract performance or legal defense, or covered by another exception.

14. Children

The Services are not directed to people under 18, and minors may not purchase them independently. If we identify data provided by a minor without valid authorization, we will delete or block it as appropriate. Parents or guardians may contact contact@videokrtoon.com.

15. Automated processing

We may use automation for security, fraud prevention, creative processing, and Service operation. We will not rely exclusively on automated decisions that produce legal effects or significantly affect rights without notice and legally required safeguards.

AI-generated creative outputs are not a legal evaluation of a user or a real-estate decision by VideoKrtoon.

16. Changes to this Notice

We will post the current version and date at videokrtoon.com/privacy-policy/. Material changes will be communicated by email, account notice, or prominent website notice. If a new purpose requires consent, we will request it before beginning that processing.

Contact contact@videokrtoon.com first so we can address your concern. You may also contact the competent Mexican personal-data authority and, for consumer matters, PROFECO.
